Privacy Policy
Last updated
The short version: this website sets no cookies and runs no trackers. The only personal information we collect is what you choose to send us through the contact form, and we use it to reply to you. We do not sell it, and we do not send marketing email.
Who we are and who is responsible
Tuwar Corporation, trading as Tuwar Corp, is a software development company based in Toronto, Ontario, Canada. In this policy, "we" and "us" mean Tuwar Corporation, and "you" means anyone who visits this website or contacts us through it.
We are accountable for the personal information in our custody. Our privacy officer can be reached at info@tuwarcorp.com or +1 (437) 997-3667. If you want to exercise any of the rights described in section 09, that is the address to use.
This policy covers this website and the enquiries we receive through it. It does not cover personal information we handle on behalf of a client while building or maintaining their software. That is governed by our written agreement with that client, where they are the party responsible for the information and we act on their instructions.
What we collect
Information you give us. The contact form on this site asks for your name, your email address, an optional phone number, and a description of your project. If you email or call us instead, we receive whatever you choose to tell us. We do not ask for, and you should not send us, sensitive personal information such as government identifiers, financial account numbers, or health information.
Information collected automatically. This site sets no cookies and loads no analytics or advertising scripts. However, our hosting provider records standard server logs when a page is requested, which include your IP address, the page requested, the time of the request, and your browser's user agent string. IP addresses can be personal information under Canadian law, so we disclose this rather than treating it as invisible. These logs exist to keep the site running and secure. We do not use them to build a profile of you, and we do not combine them with anything you send us through the form.
Why we collect it, and your consent
We use the information you send us only to:
- reply to your enquiry and answer your questions
- prepare a proposal, estimate, or scope of work if you ask for one
- deliver, support, and maintain services under an agreement with you
- meet our legal, accounting, and tax obligations
By sending us an enquiry you consent to us using your information for these purposes. That consent is implied by the act of contacting us, which is how Canadian privacy law treats information volunteered for an obvious purpose. You can withdraw it at any time under section 09, subject to any legal or contractual obligations we still have.
We do not send marketing email. We contact you about your own enquiry or your own project, and nothing else. We do not operate a newsletter or a mailing list, and we do not add you to one. If that ever changes, we will ask for your express consent first, as Canada's Anti-Spam Legislation requires.
Information processed outside Canada
Vercel and Google are based in the United States and may store or process information on servers outside Canada. While it is outside the country, that information is subject to the laws of the jurisdiction it sits in, and may be accessible to courts, law enforcement, and government authorities there under those laws.
We tell you this because Quebec's privacy law requires it and because you deserve to know. If you would prefer that your enquiry not leave Canada, call us on +1 (437) 997-3667 instead of using the form.
How we protect it
This site is served over HTTPS, so everything you submit is encrypted in transit. Access to the mailbox that receives enquiries is limited to the people who need it and is protected by multi-factor authentication.
No method of transmitting or storing information is perfectly secure, and we will not pretend otherwise. If a breach occurs that creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as the law requires, and we will tell you what happened and what we are doing about it.
How long we keep it
Enquiries sent through the contact form are forwarded to our email and are not stored in a database.
- Enquiries that do not become projects are kept for up to 24 months, so we have context if you come back to us, then deleted.
- Records relating to work we carried out are kept for seven years after the engagement ends, which is the retention period Canadian tax and limitations legislation effectively requires.
- Server logs are kept for a short operational period by our hosting provider and are then rotated out.
You can ask us to delete your information sooner. See section 09.
Your rights
Under Canadian privacy law you have the right to:
- ask what personal information we hold about you, and get a copy
- ask us to correct anything inaccurate or incomplete
- ask us to delete it, and withdraw your consent to our using it, subject to obligations we cannot set aside
- receive the information you gave us in a structured, commonly used electronic format, or ask us to send it to someone else
- ask how we make any decision that significantly affects you
- complain, without us treating you differently for doing so
Write to info@tuwarcorp.com and we will respond within 30 days. We may need to confirm your identity first, and we will tell you if an exception in the legislation prevents us from acting on part of a request.
Children
This site is aimed at businesses and is not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has sent us information, write to info@tuwarcorp.com and we will delete it.
Changes to this policy
We may update this policy as our practices change. The revision date at the top always reflects the current version. If a change materially affects how we handle information you have already given us, we will contact you directly rather than relying on you noticing the date.
Questions and complaints
Contact our privacy officer at info@tuwarcorp.com with any question or complaint. We would rather hear it and fix it.
If we do not resolve it to your satisfaction, you can complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca. Residents of Quebec may instead complain to the Commission d'accès à l'information du Québec at cai.gouv.qc.ca.
